RE: CIVILIAN CRIMINAL COMPLAINT
COMPLAINT – I wish to file a citizen complaint in regards to several entities operating in the State of NJ in open violation of: Title 21, United States Code, Sections 841(a), 846, and 856(a)(l)
JURISDICTION – Title 21, United States Code, Sections 841, 846, and 856 is a federal law and only federal officials can enforce it, thus I’m presenting this valid complaint to the (Department of Justice) U.S. Attorney – you Mr Craig Carpenito, esq..
COMPLAINTANT:
My name is Edward Forchion I am a 54 year old natural born citizen of the United States of America, I reside in your federal jurisdiction, the US State of New Jersey. I am a U.S. Army veteran and swore to uphold the constitution against enemies both foreign and domestic. I now watch NJ State Officials openly violate federal law and the US CONSTITUTIONS 14th amendment. The U.S. Constitution’s amendment 14 “equal protection clause” protects and guarantees me equality as well as every citizen of America. My GREIVANCE; The State of New Jersey currently allows 6 individuals and corporations to sell, grow and distribute marihuana while simultaneously arresting and ruining other citizen’s lives such as mine in violation of the equal protection clause. 25 thousand mostly minorities in 2016 last year stats are available.
Please regard this informal letter/document as a citizen complaint in which I demand Federal authorities enforce Title 21, United States Code, Sections 841(a), 846, and 856(a)(l) equally.
The U.S. Federal law outlaws the substance Marihuana @Title 21, United States Code, Sections 841(a), 846, and 856(a)(l) (possession with intent to distribute and distribution of a controlled substance, namely, marijuana, a Schedule I controlled substance; conspiracy to distribute a controlled substance, namely, marijuana; and maintaining drug-involved premises), personally I disagreed with this federal law but it is the law of the land and it is the Federal Governments responsibility to dispense justice equally. Currently the US department of Justice, the DEA and federal officials look the other way as this federal law is violated each day.
Currently 6 all white owned “marihuana retail stores” (I will here by refer to them as Caucasian Cannabis Corporations) operate in the State of New Jersey in violation of Title 21, United States Code, Sections 841, 846, and 856 with the help of co-conspirators NJ Senator(s) Scutari and Sweeney. While simultaneously people of color, specifically Black people are targeted and ruined (READ ACLU REPORT Black and White – https://www.aclu.org/report/report-war-marijuana-black-and-white) by prosecutor (Senator) Nickolas Scutari, he accepts donations/bribes from the CCC to remain illegal monopolies protected by this state officials and the “UNCONSTITUTIONAL STATE LAW – “CUMMA – Compassionate Use of Medical Marijuana Act – C:24-6-I” .
Senator(s) Scutari & Sweeney are now conspiring to expand this white only medical marihuana industry (CCC’s) with via another illegal state bill identified as SB2703/803 – The New Jersey Adult Use of Marijuana Act, sponsored by Senator Scutari. This bill will further enhance the racist practices of the State of New Jersey and while ignoring federal law.
I demand equal protection to sell, grow or distribute marihuana or prosecution of those so blatantly in violation of Title 21, United States Code, Sections 841, 846, and 856 and those who conspire to usurp federal law.

Mr. Carpenito, esq. You and I know all of these “stores” in New Jersey are selling, growing and distributing marihuana in violation of Title 21, United States Code, Sections 841(a), 846, and 856(a)(l) which clearly states: (possession with intent to distribute and distribution of a controlled substance, namely, marijuana, a Schedule I controlled substance; conspiracy to distribute a controlled substance, namely, marijuana; and maintaining drug-involved premises). These stores are as Federally illegal in New Jersey as my Liberty Bell Temple was in California in 2011. These NJ stores have operated with a co-conspirator in New Jersey State Senator Scutari who “under color of state law” openly conspires to violate FEDERAL LAW and has functioned as the NJ ambassador to this illegal Caucasian Cannabis Cartel. Senator Scutari now is attempting to get NJ Gov. Phil Murphy to endorse SB2703 – The Adult Marijuana Use Act, which as plainly as possible I’ve shown is federally illegal. What is the difference between what I was doing in California and what these 6 CCC’s are doing now in NJ?
BACKGROUND:
In January 2010 NJ State Senator Scutari presented to then NJ Gov. Corzine a bill (CUMMA) purporting to LEGALIZE MEDICAL MARIHUANA in the state of New Jersey, which just isn’t so. Federal Law trumps state laws. Federal law does not recognize marihuana as a medicine and it appears as a schedule 1 Illegal drug thought all federal legislation and laws. I know this for a fact in 2007 I fled the state of New Jersey seeking economic and political asylum in the State of California.
Within a few months I opened a Medical/Spiritual Temple at 5642 Hollywood Blvd., in the City of Los Angeles under California state laws.

Then at the behest of Burlington County assistant Prosecutor Michael Luciano (similar to what I’m requesting now), requested the force of the U.S. Federal Government be turned on me (LIBERTY BELL TEMPLE) despite my business being legal under state laws of California. Michael Luciano was/is a NJ state Prosecutor who turned to the Federal Government to ruin me with Federal Law; to give him what he thought was some advantage in the court case he was prosecuting me for…. He still lost btw.

On late Oct 2011 The U.S. Attorney Office in Los Angeles ordered the local DEA Drug Enforcement Agency to enforce Title 21, United States Code, Sections 841, 846, and 856. On Dec 13th 2011 The DEA raided the Hollywood Blvd Temple, The Gage Street Grow House and private resides and bank accounts and seized my property. The result was within 3 months (Feb 2012) I was out of business. Within a year I was back in New Jersey.
In 2015 I re-opened Liberty Bell Temple in Trenton, NJ 322 east State Street in anticipation of state legalization coming to NJ. I placed myself in a position to begin providing marihuana to my congregation and to selling marihuana in New Jersey.
Instead of getting protected like the 6 CCC’s named above the state of NJ & City of Trenton officials “under color of state law” enforced its WHITE ONLY MEDICAL MARIJUANA INDUSTRY and targeted me for destruction. Beginning in early 2016 and lasting for over two years including a 447 day jailing the state/city/ and local politicians used state/city law enforcement to persecute and deny me the same protections as the 6 listed above. Most of the details of this persecution can be found in Federal lawsuit 3:16-cv-01339pgs now before Judge Sheridan in U.S. District Court Trenton, NJ..
Now Senator Scutari is once again purporting to be legalizing marihuana in New Jersey for CCC’s and excluding people of color/blacks. Via this bribed NJ Senator New Jersey is on the verge of FALSELY in violation of Federal law pretending to be legalizing marihuana for everyone, not just medical marihuana patients, except selling it, growing it, and distributing it is again purposefully designed to only allow Caucasians to do. Blacks and people of color will be excluded under Senator Scutari’s SB2703 which is clearly a “DEJURE DISCRIMINATORY LAW”. This SB2703 is a Racist law, designed to exclude all but rich whitemen and corporations and no matter what Senator Scutari and his allies believe this is against FEDERAL law. It is a joke that he calls it the NJ ADULT USE of MARJUANA ACT, when what would be more appropriate the CACAUSIAN CANNABIS DISTRUBITION ACT.
If the Federal authorities refuse to enforce violations of Title 21, United States Code, Sections 841, 846, and 856.. I will also take this as a GO-AHEAD to sell weed too. I’ve already started a hashtag- #SELLWEEDLIKEIMWHITE and will begin other marketing promotions and will begin selling weed like the CCC’s. I ask that you respond as soon as possible as one other option to stopping sb2703 will be seeking a Federal Injunction on SB2703 via the Federal Courts.
